1. Acceptance of Terms

By engaging Xness ("we", "us", "our") for any service, or by using this website, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

2. Services

We provide content production, short-form video, and growth marketing services as described in the individual contract or scope of work signed with each client. Deliverables, timelines, and pricing are defined in that contract.

3. Client Responsibilities

Clients are responsible for providing timely access to brand assets, approvals, source material, and any information required to perform the services. Delays caused by missing inputs may shift deliverable timelines.

4. Payments & Billing

Fees, invoicing schedules, and payment terms are defined in the signed contract. All payments are due within the period stated on the invoice. Late payments may result in a pause of active work until the account is brought current.

5. Refunds & Cancellation

Our refund and cancellation terms are described in our Return, Refund & Cancellation Policy.

6. Intellectual Property

Upon full payment, the client owns the final delivered creative assets produced specifically for them. Xness retains the right to use delivered work in our portfolio, case studies, and marketing material unless otherwise agreed in writing.

7. Confidentiality

Both parties agree to keep non-public information shared during the engagement confidential and to use it only for the purposes of performing the agreed services.

8. Limitation of Liability

To the maximum extent permitted by law, Xness's total liability for any claim arising out of or related to the services shall not exceed the fees paid by the client for the specific deliverable that gave rise to the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate the engagement in accordance with the terms of the signed contract. Termination does not relieve the client of the obligation to pay for work completed up to the termination date.

10. Governing Law

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts located in India.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of our services after changes constitutes acceptance of the updated Terms.
